Privacy Policy Overview

Definer, Inc., a Delaware corporation (“Definer”, “we” or “us”), sets forth this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of information of users, including but not limited to personal information, which we receive from users of any services provided by us under the name of PrismScaler (the “Service”). This Privacy Policy applies only to information that you provide to us in relation to the Service.

1. Information Collection and Use

a. Personal Information for Your Account Registry

You can register to join by completing certain required forms.

When you register with us for the Service, we may ask you for your personally identifiable information; specifically, information about you that can be used to contact or identify you (“Personal Information”). Personal Information includes, but is not limited to, your name, the name of the company where you work or you represent , contact information such as email addresses, and personal information such as date of birth. If you fail to provide such information, you may not proceed with registration, and we will not be liable for any losses or damages you might incur as a resolt of the non-registration of your Personal Account.
Further, when you log into our site for the Service via a service provided by a third party, such third party may collect your information including Personal Information.

We will own or possess certain information from third party contractors or service providers in the process of your registration to assist us in evaluating your eligibility to register with our Service. Such information shall include, but not limited to, credit history reports, criminal history reports and other reports we reasonably believe necessary.

b. Data for the use of the Service

Before you can use the Service after registering your account with us, you must provide us with the information of the device (ex. Internet Protocol address of your computer) or the website (ex. URL) via which you will use the Service and any data we may require for the performance of the Service, such as cloud credentials.

c. Data automatically collected during the use of the Service

When you use the Service, our servers may automatically collect and record information which your browser sends to us by “cookies” (a cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes), heat maps, web beacons, and log files (“Log Data”). We may also collect information we need for processing payment for your use of the Service.

2. Purpose of Use of the Information

Our primary goals in collecting information are to provide and improve our Service, features and content, to administer your use of the Service, and to enable us to assist you and our other customers in using the Service.

Specifically, we use your information referenced above (“Customer Information”) in the following ways.

a. Provision of the Service and Customer Support

We use your Customer Information to provide the Service and for customer support purposes, such as to answer your inquiries. Please note that we may also use your Personal Information in order to contact you regarding your use of the Service.

b. Announcements by Definer

We also use your Customer Information to contact you with our newsletters, marketing, promotional materials and other information that may be of interest to you.

c. Research and Development

We may use your Customer Information to monitor and analyze the use of the Service, for technical administration, to increase our Service functionality and user-friendliness, and to better tailor our Service to our customers' needs.

d. Use for Dispute Resolution, under laws and order of government

We may use the Customer Information if necessary to research and handle any claims or disputes with regard to the Service by our customers, provided that we are entitled to use the Customer Information under applicable laws or are so required by orders from applicable government authorities.

Definer cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal processes (including, but not limited to, subpoenas), to protect the property and rights of Definer or any third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or poses a risk of being, illegal, unethical or legally actionable activity.

e. Payment Procedure

We may use your Customer Information to process payment of the Service fees.

f. Machine Learning

We may combine your Customer Information, including your Personal Information, with other information that we collect during your use of the Service in deep learning processes, in an attempt to provide you with a better experience, to improve the quality and value of the Service and to analyze and understand how our Service is used. However, data collected in deep learning will not be aggregated with information collected from other customers.

3. Information Sharing with a Third Party

We will not share your Customer Information with a third party unless we obtain your agreement or we are allowed to do so under applicable laws.

4. Cookies

Like many other providers, we use “cookies” to collect information. We use cookies mainly for the following purposes.

  1. First, we utilize cookies to identify your account in our records.
  2. Second, we utilize cookies to gain a better understanding of how you interact with the Service.
  3. Third, we utilize cookies to monitor aggregate usage by our customers and web traffic routing on the Service.
  4. Fourth, we utilize cookies for advertisement campaigns and to analyze such campaigns’ efficiency. Third party advertisers on our site may also place or read cookies on your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of our site or all functionality of the Service.

5. Service Providers

We may employ traffic analysis tools and behavioral targeting advertising services managed by third parties to gain a better understanding of your interaction with the Service and to provide appropriate advertisements to our customers. We have not allowed these third parties to have access to, disclose or use your Personal Information for any purpose.

6. Deletion of Your Information

All of our customers may review, update, correct or delete the Personal Information in their registration profile by contacting us at contact form(https://definer.jp/contact/).

If you woold like us to cancel your account and delete your Customer Information, please delete your account on the site of the Service. After such deletion of your account, your Customer Information will be deleted immediately or after a period of reservation, provided that we do not have any legal obligation or a legitimate business reason to retain the information contained in your account.

7. International Transfer

Your information will be processed in computers or servers located in the United States and Japan, where the privacy laws may not be as protective as those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

8. Links to Other Websites

Our Site contains links to other websites. If you click on another third party link, you will be directed to that third party's website. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other websites follow different roles regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.

9. Policy Updates

This Privacy Policy may be updated from time to time. We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes or updates we will notify you by email (sent to the e-mail address specified in your account) or a notice on the site or other means. Once you use the Service after we notify you of such changes or updates, you will be deemed, to the extent permitted by applicable laws, that you agree with such changes or updates. 10. Security

a. General

Definer is very concerned with safeguarding your information. When you enter sensitive information (such as a credit card number) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. b. Phishing

Identity theft and the practice currently known as “phishing” are of great concern to Definer. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your Definer Account ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication.

11. Our Policy Towards Children

The Service and our site are not directed to individuals under 18. We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she shoold contact us at contact form(https://definer.jp/contact/). If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.

株式会社Definer(以下「当社」といいます。)は、当社がPrismScalerの名称で提供するサービス(以下「本サービス」といいます。)を利用するにあたって、会員が当社に対して提供する会員の個人情報を含む利用者情報(以下の「当社が収集する情報」に記載された情報を意味します。)の取扱いについて、以下のとおりプライバシーポリシー(以下「本ポリシー」といいます。)を定めます。

1. 当社が収集する情報

a. アカウント情報

当社は、会員が本サービスのアカウントに登録する際に提出する個人情報を収集することがあります。これには、会員の名前、会社名、連絡先情報(電子メールアドレスを含む)、およびプロフィール情報が含まれます。会員が第三者が提供するサービスを経由して会員が本サービスにログインした場合、当該第三者からプロファイル情報が収集されます。

当社は、会員へのカスタマーサポートを提供するために、利用者情報を使用します。

当社はプロモーションやマーケティング活動の一環として、会員にメッセージを送信します。

d. 調査および開発

当社は、調査、テスト、分析および製品開発のために、収集した利用者情報を使用します。これにより、当社が、会員がどのように当社のサービスを使用するのかを理解し、製品を改善することが可能になります。

e. 法律上の手続と要件

当社は、会員による本サービス利用に関する請求または紛争について調査ならびに対処を行う必要がある場合、適用されるその他の法律により許可されている場合、または規制当局、政府機関その他の権限のある公的機関によって要求された場合に、収集した利用者情報を使用する場合があります。

f. 本サービスに関する支払い

より良いサービス提供を行う為、会員が本サービスを利用した際のデータを利用して機械学習を行うことがありますが、機械学習モデルによって収集されたデータは、他の会員のモデルとは共有されません。

当社は、法令で認められる場合を除いて、利用者情報をお客様の同意なく第三者に提供することはありません。

本サービスでは、以下のような目的でクッキーや類似した技術を使用します。

5. 外部サービスの利用

6. 情報の削除と保持

会員が本サービス上で自身のアカウントを削除すると、利用者情報は削除されます。削除は、直ちに、または保存期間の後に実行されます。

7. データ処理が行われる地域の情報

本サービスを通じて収集された個人情報は、日本および米国内で処理されます。本サービスを通じて収集されたデータの処理は、本ポリシーの規定並びに日本および米国の法律に基づいて行われます。

8. 当社以外へのウェブサイトのリンク

当社のウェブサイトには、当社以外の法人、団体等のウェブサイトへのリンクが含まれている場合があります。当社は、そのような当社以外のサイトにおける個人情報の取り扱いについて責任を負うものではありません。

9. 本ポリシーの更新

必要に応じて、当社は本ポリシーを変更または更新する場合があります。重要な変更または更新がある場合は、当社は、会員に対し、電子メールなどの手段で、当該の変更または更新に関する通知を送信します。会員が当該通知後に本サービスを利用した場合には、適用される法律が許容する範囲において、当該会員は、本ポリシーの変更または更新に同意したものとみなします。
